Legal Malpractice Action Changes the Void Ab Initio Doctrine

On Monday, February 20, 2006, the Illinois Supreme Court submitted an opinion in a legal malpractice case, which has now changed the way the doctrine of void ab initio will be used in Illinois. For 92 years the Illinois supreme court have used the U.S. Supreme Court case Norton v. Shelby County as an example to follow in ruling a void ab initio scenario.

Supreme Courts Protecting The Attorneys?

In Late June 2006, The Illinois Supreme Court limited the types of damages that a client could receive from lawyers who botch a lawsuit. It was a 4-3 decision in this first-of-its-kind case that helps lawyers that are being accused of malpractice. The Court ruled that a client may sue their lawyer for the standard, compensatory damages that could have won the case, only if their suit had been properly represented.

Circuit Judge Brandt Denies Motion to Dismiss Malpractice suits

On July 1, 2006 a legal malpractice suit was denied dismissal in Peoria last week. The suit involved Marshall County's gravel pit controversy. Circuit judge Michael Brandt also denied dismissal in a peoria county case that was brought against Husch & Eppenberger, LLC, and three of its attorneys.

IInglewood Sues Lawyers in Police Beating
The city of Inglewood, CA is suing a law firm that represented it in a civil lawsuit against ex-police officers Jeremy Morse and Bijan Darvish. The lawyers for the policemen convinced a the court that the two officers were discriminated against in the 2002 brutal arrest of teenager Donovan Jackson.

In Manhattan, a Federal judge dismissed a legal malpractice suit in which well-known litigator Edward W. Hayes was accused of sleeping through the deposition of his client, Robert Flutie. The judge ruled that the Flutie Companies were held liable for $191,089 in loans.

New York Firm Settles Legal Malpractice Claim

The 1200 lawyer firm of Weil, Gosthal & Manges chose to settle a conflict of interest malpractice claim only a few days before the case was to go to trial. The dispute was over whether Weil, Gosthal was out of line when it represented mall boutique owners in an unfair trade suit against Fendi. The conflict of interest arose from the fact that the firm started representing Prada around the time the company was part of a venture to buy Fendi.
